King County owns the 156-acres site located at 22801 S.E. 272nd St., which is inside the Maple Valley city limits.

The county is in the process of selling the land, also known as the donut hole, to YarrowBay, a Kirkland-based developer, for about $51 million.

The land deal was originally supposed to be completed in February, but the county and YarrowBay struck a deal for an extension, which gives the developer another year before paying $1.75 million in earnest money.

The extension required a revised interlocal agreement to be crafted by Maple Valley, which will be signed by Johnston if the County Council approves the agreement unchanged.

The council and staff wants to ensure the property will be annexed by Maple Valley prior to development, which allows the city some control over the process and the impact fees.

The city hopes to have the annexation completed by the end of the year.

City Attorney Christy Todd walked the members through the legal labyrinth of the agreement, including the escape hatches if the annexation process runs into a road block or worse.
